Ban on Residential Burning Lifted in Montgomery County

The ban on residential burning of limbs and leaves in unincorporated parts of Montgomery County has been lifted.
All other burning must follow applicable state law.

In Montgomery County, burning of trash or rubbish is prohibited by state law in or near subdivisions or on less than 5 acres. Tx Local Govt Code 352.082
LAND CLEARING: State Law prohibits the burning of land clearing debris on the surface of the ground in most of the Houston area, including Montgomery County, due to air quality.
Land clearing debris may be disposed of by hauling to a green waste recycling facility, by chipping or mulching, or by burning in a properly constructed pit with an Air Curtain Incinerator permitted through and operated in accordance with regulations set forth by the Texas Commission on Environmental Quality.
